Our Constitution

CONSTITUTION OF ‘WE CARE WELFARE SOCIETY’ (WCWS), JAMMU

A. NAME OF THE SOCIETY

The name of the Society shall be “WE CARE WELFARE SOCIETY” (WCWS) (hereinafter referred to as the Society)

B. REGISTERED OFFICE

The registered office of the Society shall be at “ROOPMANI ENCLAVE’ Patel Nagar Talab Tillo, Akhnoor Road Jammu – 180002. (Adjoining Govt. ITI Jammu).

C. AREA OF APPLICATION.

“WE CARE WELFARE SOCIETY” (WCWS) shall provide necessary help & awareness to poor & needy people in both rural & urban areas.

D. AIMS & OBJECTIVES.

The main aims of the Society shall be;

  • To provide assistance to the BPL/needy patients in
    finding suitable doctors/specialists & hospitals for consultation & treatment of their medical problems. The Society will keep latest information of specialist doctors & hospitals required for treatment of needy patients. The Society will act as a link between doctors, hospitals and needy patients.
  • To help patients and their attendants, to find suitable
    accommodation at reasonable and nominal rates near and around the hospital where patient is admitted.
  • To help in blood donation for the most needy patients.
    The Society will keep record of all its members of their blood groups at the time of their registration. The Society members will also participate actively in blood donation campaigns, during natural disasters, calamity and in war like situation.
  • To provide monetary help to the needy patients for the
    purchase of medicines and accessories, as far as possible.
    Also, Society will provide one time meal to the needy attendants of the patients in the hospital premises depending on availability of funds /donations.
  • To help in providing ambulance services for the needy
    patients, in the beginning through ambulance providing operators till our own ambulance is arranged.
  • To help arranging medical camps in different places,
    especially in rural areas depending on their specific needs, such as eye checkup, diabetes, orthopedics, physiotherapy, ENT, dental, general health, etc
  • To organize civil awareness lecture/ talk in school,
    villages & participate in all activities which are beneficial for the society such as food adulteration control, pollution and environmental control, sewages and solid waste disposal, protection of rivers/Canals/water bodies, awareness and harmful effects of burning of solid waste and plastics in open, stoppage for use of plastic bags, tree plantation, Swachh Bharat Campaigns, Yoga classes, National Food Nutrition programme (mal nutrition), children vaccination programme, Walk, Run & Tracking for physical fitness and health, Improvement of civic & general hygiene of rural population, old age care, community centre for senior citizens, help during natural disasters, calamity, fire, floods, cyclone, motor accidents, awareness & participation in State & Centrally Sponsored Schemes, sharing ideas amongst fellow members & mutual help for each other, etc. The Society members will also undergo First Aid Training from Int’l Red Cross, to help the needy during emergency situations.
  • The corpus fund and receipts of the Society collected
    from members shall be utilized only for activities underlined from para (a) to (g) and no Commercial or Political activities shall be done by the Society and to perform all other activities which are incidental and ancillaries to object underlined from para (a) to (g) and to do all other works and activities to achieve these objects. The above aims and objectives are of General Public Utility, are purely charitable in nature and are not motivated for profit.

E. COMPOSITION OF MANAGING BODY / EXECUTIVE BODY/GENERAL BODY.

i. General Body

1. All members of the Society shall be known as General Body.

2. Membership of the Society, shall be subject to the approval of the Governing Body. Any person who applies for the membership should be recommended by at least two existing members of the Governing Body. Any person, who is interested in charitable work, shall be generally granted membership.

3. One time registration fee for membership of the Society at present is Rs. 100/- . It can be increased /decreased by Managing Body from time to time.

4. Annual contribution for carrying out the activities of the Society, shall be decided in the Annual Managing Body Meeting and thereafter approval of the Governing Body.

5. Member who do not observe the rules and regulation of the Society or work against the interest of the Society shall be likable to expulsion of membership. However reasons for expulsion shall be communicated to the outgoing member.

6. Expelled member may be re-admitted if the Managing Body is satisfied that the activities of the member expelled have become conductive in the interest of the Association.

7. The members shall take part in the proceedings of the General Body meeting and elect Principal office bearers of the Society, namely (i) Chairman (ii) President (iii) Sr. Vice President (iv) Vice President (Women Wing) (v) General Secretary (vi) Treasurer( vii) Organizing–cum-Information Secretary (viii) Executive Members – 3 Nos (ix) Advisory Committee Members – 3 Nos.

8. The decision of far-reaching consequences and of radical nature shall be taken by the General Body.

9. General Body shall approve annual accounts of the Society along with budget of the next year and Annual Progress Report.

10. General Body will meet at least once in a year, preferably in April every year.

11. Fourteen (14) days clear notice in advance shall be given for convening
General Body meeting. Quorum shall be 1/3rd of the total members or 15
(Fifteen) members whichever is less.

12. The General Body shall also consider any proposal brought
forward by the Managing Body.

13. All members shall be bound by the rules and regulation of
the society which may be framed from time to time.

i. Managing Body
Governing Body shall consist of 7 members and their designations shall be as under:
(i) Chairman (ii) President (iii) Sr. Vice President (iv) Vice President (Women Wing) (v) General Secretary (vi) Treasurer( vii) Organizing–cum-Information Secretary.

ii. Executive Members
The executive body shall consist of eight members.

iii. Advisory Committee Members
The advisory committee shall consist of three members.

E. FUNCTIONS OF MANAGING BODY AND OFFICE BEARERS VIZ., PRESIDENT,SR.VICE PRESIDENT,VICE PRESIDENT WOMEN (WOMEN WING),GENERAL SECRETARY,TREASURER , EXECUTIVE MEMBERS, ADVISORY COMMITTEE MEMBERS & MEMBERS

i.POWER,DUTIES AND FUNCTIONS TO THE MANAGING BODY:

1) Authorize expenditure and take financial decisions in respect of the
Society.

2) Take all the important decisions in respect of the any activity to be
undertaken by the Society.

3) Terminate the membership of the Members.

4) Appoint sub-committees for the promotions of aims and objects of the
Society , to guide them and to dissolve the sub-committee on the
completion of the work assigned to the sub-committees.

5) Execute proposals approved by the General Body.

6) Co-operative with other Associations and Societies having the objects
similar to those of this Society and also to seek their co-operation ,
if necessary.

7) Contact the concerned authorities to solve the problems of the Society
and to meet concerned Government Agencies, Hospital Authorities and
departments, from time to time to achieve objects elaborated in object
clause of these Bye Laws.

8) To organize any seminar, function & meeting (meetings) to achieve
these objectives.

9) Do all other acts, needs and things which are necessary for the
promotion of the aims and objects of the Society.

10) Managing Body shall meet at least once in Three (3) month for which Ten
(10) days clear notice shall be given to all the members of the Managing
Body.

11) Quorum shall be 1/3rd of the total strength or three members whichever
is less. However, out of those present, one should be at least
Chairman or President.

12) The Managing body shall have power to Co-opt a member of the Managing
body.

ii.POWERS AND DUTIES OF THE MANAGING BODY:

1.CHAIRMAN

a) Shall preside over the Governing Body/General Body meeting, if present.
b) Shall guide the activities of the Society and further the aims
and objectives of Society. The Chairman may allocate all or any of the powers and duties under this or any other clause of these rules to the President or to the General Secretary.
c) Call emergency meeting of the Society if and when
considered necessary.
d) Shall have casting vote-right in case of tie

2. PRESIDENT

a) Shall preside over the Governing Body/General Body
meeting in the absence of Chairman.
b) Shall have correspondence and negotiations with
government/Semi-Government and other bodies on behalf for the Society.
c) Shall authorize sanction of any expenditure in the interest of Society.
d) Shall pass expenses of the Society.
e) Spend any amount for the completion of the Society work
without prior permission of the Governing Body.

3.SR. VICE-PRESIDENT

a) Shall assist President in performing all activities of the
Society.
b) Shall perform all responsibilities of the President, in his
absence

4. VICE-PRESIDENT (WOMEN WING)

a) Shall co-ordinate and interact with female members
frequently and apprise them of various programmes and activities to be undertaken by the society.
b) Motivate, encourage and ensure that the female members participate and take active part in all social activities of the society.

5. GENERAL SECRETARY

a) Shall call the meetings of the Society.
b) Shall assist the President in the discharge of his functions
and duties.
c) Record the decisions of the Governing /General Body and
their implementations.
d) Look after the overall functioning of the Society and
exercise check of accounts.
e) To prepare annual accounts budget of next year and the
annual progress report.
f) To instruct the members of the Society in matters
considered necessary for its smooth functioning.

6. TREASURER

a) Shall operate /handle the cash and make payments /receipts wherever necessary.
b) Shall be responsible for maintenance of accounts of the
Society in the proper form.
c) Make payment of the bills, voucher all passed by the
President to obtain proper accounts thereof.
d) Collect fees , subscription , donations, gifts etc. in the name of behalf of the Society.

7. ORGANIZING CUM INFORMATION SECRETARY

a) Shall help in organizing all functions and activities of the
Society, in full co-ordination with President and General Secretary of the Society.
b) Shall keep liaison with other Association and Societies, undertaking similar charity work.
c) Shall render help in disseminating information relating to activities and programmes carried out by the society, to the members and public at large, and in preparation of banners, leaf lets, brochures etc.

iii. FUNCTIONS OF EXECUTIVE MEMBERS

a) The Executive members shall help the society in executing
various activities from time to time. Their participation and help shall be of paramount importance for functioning of the society.
b) A separate meeting executive members, advisory committee members and all other office bearers, shall be held once in three months or earlier if required to review the ongoing activities and future programmes of the society

iv.FUNCTIONS OF ADVISORY COMMITTEE MEMBERS

a) The advisory members shall interact with the managing
body intermittently and their role shall be in advisory in nature.
b) They will also guide the managing body as and when
occasion so demands.

v. FUNCTIONS OF MEMBERS

a.The members shall participate in the proceedings of the
meeting or the General Body and in taking the decisions by voting. The decisions would generally be by consensus and unanimously.
b. There shall be a quorum of 1/3rd of the total members or 15
(fifteen), whichever is less, of the General Body for its meetings.
c. A notice of 10 days in writing is necessary to convene the
meetings of the General Body.
d. The vacancies of the Chairman, President, General
Secretary and Treasurer and other elected members, caused by the resignation, death or otherwise, shall be filled by the members of General Body.

G. ELECTION PROCEDURE

A General Body Meeting shall be convened to elect the Principal Office Bearers/Managing Body, beside executive and advisory committee members. The notifications for holding the election shall be issued for all members of the General Body atleast 15 days before its due date so as to facilitate maximum participation. The Election of Managing body and Principal Office Bearers will be for a period of 3 (Three) years. The Candidates eligible for above cited posts shall necessarily be the members of the society.

H. AMENDMENT QUORUM

Amendment (s) to the constitution of the society will only be undertaken if genuine and compelling reasons warrant for its enactment. A General Body Meeting shall specially be summoned for this purpose and adequate one weak notice in advance shall be communicated to all the members through notice. The Quorum for carrying out amendment procedure shall be 1/3rd of total strength or 25 members, whichever is less.

I. GENERAL QUORUM FOR PASSING THE RESOLUTION

The Quorum for passing the resolution shall be 1/3rd of the total
strength or 15 members, whichever is less.

J. SOURCE OF INCOME

a) The main source of income shall be from
registration/membership fees, annual donations, collected from members.
b) The other source of income shall be from the gifts,
donations and savings from social, cultural and education functions and charity shows.
c) The funds so collected shall be utilized to achieve the aims
and objects of the Society.

K. AUDITING PROCEDURE

The account of the Society shall be audited by the Chartered Accountants, who shall submit his report every year to the General Body.

L. FINANCIAL YEAR

The financial year of the society shall commence from 1st April and end 31st of March of the next year

N. ANNUAL LIST OF THE MANAGING BODY.

Once in every year the list of the office bearers and members of the Managing Body, shall be filed with the Registrar of Association, Jammu & Kashmir, as required under section 5 of the Jammu & Kashmir Association Registration Act of 1998 (1941 A.D.)

O. LEGAL PROCEDURES

The President of the Society or any other member so authorized by him shall be responsible to take any legal proceedings on behalf of the Society

P. DISSOLUTION

If the Society needs to be dissolved it shall be dissolved as per the provisions laid down under section 11 & 12 of the J&K Association Registration Act. It is hereby expressly stated that in the event of dissolution of Society, the Assets Property and Funds of Society shall be transferred / given to another registered Society or institution carrying similar objects registered under Income Tax Act and Association registration Act.
